In 2012 i left my wife of 9
In 2012 i left my wife of 9 years, moved to connecticut and filed for divorce. The house was sold via short sale, each of us got a car, no children and she got the entire contents of the house. In the first hearing before the divorce hearing the ordered me to pay $300.00 per week and $50.00 a week towards arrears.On august 5th 2014 at the divorce hearing i was ordered to pay 350.00 a week and to pay $21,000 towards my wife's credit card debt. Also on sept. 1st the alimony was reduced to $250.00 as my public service pension was cut in half.After my pension was cut my monthly total fixed income is $3100.00. In the order I was required to make two yearly good faith efforts to roll the debt over to my name however I was not ordered to make any weekly payments.There are 4 credit cards involved and in the first 8 months following the divorce I borrowed money and paid off two of the 4 cards. It should be noted that during this whole process I have not once failed to make my alimony payments. In March 2015 I was subpoenaed by my ex wife's attorney. In her motion she asked that I be held in contempt and incarcerated for failing to make regular payments towards the credit cards. She also asked that I pay $1325.00 in attorneys. I was angry and rightfully so as i had complied with the orders handed down initially. My attitude in court reflected this anger but the judge never told me I was out of line. I feel my attitude had a great amount of influence regards the new orders handed down. In the new finding I was ordered to pay $$1989.00 in combined alimony and credit card payments. This to be paid in full on the 1st of each month. My pension check which i receive on the 1st is $1800.00. I do not receive anymore income until the 3rd wed. of the month when i receive $1300.00 in early social security payments.After bill obligations I have nothing left. I am borrowing money to eat and buy medicine as well as put gas in the car. I was found in contempt(still don't know why) and ordered to pay my ex wife's attorney $4000.00. The judge and the attorney had copies of my bank statements and knew of my inability to make this payment,and i was ordered to pay it in 10 days or be held in contempt. I did pay it by borrowing more money. They have made two attempts to garnish my pension check that didn't work out so they are trying a third time.If they are successful they will get 65% of my pension requiring me to write another check. Like i said earlier i pay my alimony on time every week and now every month.Yet they still want to garnish my check.I was also ordered to obtain a second life insurance policy listing my ex wife as the beneficiary and given 30 days to do this. At the time of this order I already had an application for a second policy and was awaiting a physical exam. There were delays in setting up the physical which is now set for June 25th . However it is past the 30 days and i expect to be found in contempt. My attorney, who I can't pay anymore) called a few days ago and advised that my ex wife's attorney has filed another motion calling foe me to be found in contempt and punished. In her motion she complains that I wrote alimony on my last check as part of the check is for credit cards. She also complains that i haven"t obtained a second insurance policy and that I am not putting the proper amounts on my alimony checks. In regards to that, between may 22nd and june 1st i sent over $2700.00 to my ex wife. Remember i have a monthly income of $3100.00. The attorney also wants me to pay $700.00 that she says she paid to hire an attorney to process a quadro to garnish my paycheck.I feel like i"m heading for jail as the ordered payments are not sustainable.Once my borrowing ability is gone I don't know what i"m going to do and my borrowing power will soon be gone. I believe the judge set me up to be incarcerated as he was fully aware of my income. I also find that the $4000.00 payment negotiated between the judge and attorney to be fraudulent . I have filed a complaint against the judge and am in the process of filing one against the attorney. I have been notified that my complaint against the judge was received and will be presented to the judicial review board but i"ve heard nothing since. I now sit around waiting for contempt motions and worrying about going to jail. I already have suffered PTSD most of my life but have managed OK until now. I;m now taking 200mg of zoloft which I have never had to take before. Like i said i just wait around wondering not if i go to jail but when i'll go to jail.
